Travel Butlers Guest Info App Terms And Conditions Of Use
1.1 These terms and conditions, as may be amended from time to time, apply to all services and information made available through the Travel Butlers Guest Information App (the App).
1.2 By using the App, you acknowledge and agree to the terms and conditions set out below; accordingly, if you disagree with these terms and conditions or any part of these terms and conditions, you must not use the App.
1.3 All bookings made through Travel Butlers Ltd and viewed through the App remain subject to Travel Butlers standard Booking Terms & Conditions.
2. Use of the App
2.1 The App requires users to provide login details to view their travel arrangements. These login details are available to clients from their usual contact at Travel Butlers Ltd.
2.2 The App is made available free of charge to clients of Travel Butlers Ltd for private use. Clients of Travel Butlers can provide their login details to their friends and families at their own discretion so they can see the Client's itinerary details.
2.3 Whilst most content is available offline, the following will require a data connection and you may be charged for this by your network provider: live flight status; weather forecast updates; interactive maps; itinerary notifications and itinerary updates.
2.4 If your device has an active internet connection when the device is opened, the App will check to see if updates are available. You may be charged for this usage by your network provider.
2.5 Flight status updates are available for most scheduled airlines 1 day before the scheduled departure of the flight. We cannot guarantee that updates will be available for all flights on a clients itinerary as not every airline provides live updates, and in particular live updates are not available for shuttle flights and charter flights between safari lodges.
2.6 Unfortunately not every itinerary can be made available through the App, and access to the App is not guaranteed for all customers of Travel Butlers Ltd.
3. Disclaimer of liability
3.1 Whilst reasonable effort has been made to ensure the information provided through the App is accurate, we accept no responsibility or liability for any inaccuracies, omissions or errors.
3.2 You can access other sites via links from the App. These sites are not under our control and we are not responsible in any way for any of their contents.
3.3 Although we will do our best to provide constant, uninterrupted access to the App and the web services used to provide notifications, live weather forecasts, interactive maps and flight updates, we do not guarantee this. We accept no responsibility or liability for any interruption or delay.
3.4 Any driving routes shown by Google Maps are for illustrative purposes only, and we accept no responsibility or liability for any inaccuracies or errors. Drivers should consult the driving directions provided, especially when driving to/from game reserves or national parks where guests may be required to use different entrance gates depending on the lodge they are staying at.
3.5 We cannot accept any liability for any data roaming charges (either mobile network or Wi-Fi) incurred whilst using the App.
4. Limitation of liability
You acknowledge and agree that, to the fullest extent permitted by applicable law, regardless of the form of action, whether in contract, tort (including negligence) or otherwise, in no event will Travel Butlers Ltd or its affiliates, including, without limitation, their respective officers, directors, employees, successors and assigns, be liable to you or any other party for any direct or indirect loss, damage, cost, expense or liability of any kind ("loss") arising in any way out of or in connection with the availability, use, reliance on, or inability to use the Travel Butlers App, including (without limitation): (i) damages for business interruption, loss of business and other profits, loss of programs, cost of replacing equipment or software or loss of records, information or data, loss of use of data, loss of revenue, loss of goodwill, loss of customers, loss of or damage to reputation, loss of capital, downtime costs, loss under or in relation to any other contract, or loss of anticipated savings or benefits; (ii) any indirect, special, exemplary, punitive, incidental or consequential loss; or (iii) any loss attributable to errors, omissions, or other inaccuracies in the Travel Butlers App. The exclusion of liability in this section 4 applies even if Travel Butlers Ltd shall have been advised of the possibility of such loss.
Because some states or jurisdictions do not allow the exclusion or limitation of liability for particular kinds of loss, in such states or jurisdictions, Travel Butlers Ltd's liability shall be limited to the extent permitted by law (thereby minimizing Travel Butlers Ltd's liability to you to the lowest amount that applicable law permits).
5.Governing law & jurisdiction
These terms and conditions are governed by English law and the parties agree to submit to the exclusive jurisdiction of the English courts.
